Wesley indicted; Prosecutor wants death

DAYON, Ohio (WDTN) - Montgomery County Prosecutor Mat Heck wants death for a convicted killer who's accused of shooting a Dayton teen.

At news conference March 8 announcing a grand jury indictment of Dameon Wesley, Heck said he would ask for the death penalty.

Wesley, a convicted killer who had just recently been paroled, is accused of fatally shooting 13-year-old Briona Rodgers Feb. 24, 2013, in a house on Home Avenue. Another teenager was critically wounded in the shooting.

Wesley, 39, is charged with murder, attempted kidnapping, an aggravated robbery.

Wesley was released from prison in Ohio in September 2012, despite the pleas of not only the mother of his 1994 victim, but also against the recommendation of the Montgomery County Prosecutor's Office.

"The parole board is the one who didn't hold him responsible to the fullest extent of the sentence," Heck says.

Heck was angered by the Parole Authority's response to the situation.

"The parole board simply says, 'the parole board is monitoring the situation closely and expects serious crimes like this are fully investigated and those responsible are prosecuted to the fullest extent of the law,'" Heck says. "I mean are they serious? What kind of response is this when asked about their own conduct. It's shameful. They should take the responsibility for their decision and their poor judgment."

After his arrest Feb. 26, Wesley was being walked from police headquarters to the Montgomery County Jail when he told 2 NEWS photojournalist Bear Everett, "There's still good guys up in the joint that deserve their freedom. I'm just not one of them, I guess."

Wesley is is being held on a $2 million bond.
